From Attorney Ann Rankin to the Lushmeadows Board of Directors:

We received the judge's ruling today. The court found that the 2003 CC&Rs are valid and enforceable. He found that the 1990 CC&Rs were, until replaced by the 2003 CC&Rs, valid and enforceable.

He awarded us past assessments against Taggs, Wray and Whalleys. He awarded us costs of suit to be identifed in a Memorandum of Costs. We will now prepare the Memorandum of Costs and a Motion for Attorneys' Fees.

The judgment did not specifically identify attorneys fees but they should be recoverable as costs under Civil Code 1354.
